Product Terms of Use & Agreement

Medwise Consulting Pty Ltd (ABN 28 656 857 733) (Medwise Academy, Medwise, we, our, us) provides e-learning courses, consulting, and other training and advice for professionals. This Product Agreement outlines the terms and conditions for accessing and participating in our online courses and services.

By registering for or participating in any online course or service provided by Medwise, you acknowledge that you have read, understood, and agree to:

Our Privacy Policy.

If you do not agree with any of these terms, you must immediately stop using our services and products.

This Product Agreement may be amended by us from time to time. The latest version of this Agreement will always be published on our website.

Course Access and Participation

Access:
Payment for a course allows participation by one individual per account. Sharing your login credentials or course access with any other person or organisation is strictly prohibited unless otherwise authorised by Medwise. Each course is accessible for one year from the date of purchase, after which your access will expire unless otherwise agreed in writing.

Prohibited Solicitation:
You agree that, without our prior written consent, you are prohibited from directly or indirectly engaging, employing, or soliciting any person involved in the delivery of our courses for a period of twelve (12) months following course completion.

No Guarantees:
Medwise makes no representations or guarantees regarding the outcomes, success, or potential earnings resulting from participation in our courses. Your success depends on your commitment, business conditions, and how you apply the information and strategies provided.

Information Provided During Courses

Not Professional Advice:
The content of our courses is for educational purposes only and does not constitute legal, accounting, or financial advice. You are encouraged to seek professional advice tailored to your specific situation before relying on any course materials.

Liabilities and Indemnities

Release of Liability:
You agree that Medwise and its directors, employees, contractors, agents, and representatives (indemnified officers) are not liable for any personal injury, loss, or damage arising from your participation in our courses. By registering, you release and hold harmless Medwise and its indemnified officers from all claims related to your participation.

Consumer Law:
This Product Agreement does not exclude any rights you may have under Australian Consumer Law (ACL). Our liability under the ACL is limited to, at our discretion:
The re-supply of services or the payment of the cost of re-supplying the services; or
The replacement, repair, or payment of the cost to replace or repair any goods provided.

Exclusion of Liability:
To the extent permitted by law, Medwise excludes all liability for any direct, indirect, or consequential loss or damage arising out of or in connection with participation in our courses, including loss of data, revenue, or profits.

Intellectual Property and Confidentiality

Intellectual Property:
All course materials, content, and intellectual property rights are owned by Medwise. You agree not to reproduce, distribute, or share any course materials without our prior written consent.

Confidentiality:
You agree to keep confidential any information shared by Medwise or other participants during the course. This confidentiality obligation continues after your participation in the course ends.

Payment and Refunds

Payment:
Payment must be made in full before gaining access to any course or product. We use third-party payment processors (e.g., PayPal, Stripe) to handle transactions. By using these services, you agree to their terms and conditions.

GST:
All course fees are inclusive of GST unless otherwise specified.

Refunds:
Refunds are available only in accordance with Australian Consumer Law or where specified in writing. We do not offer refunds for change of mind. You are responsible for ensuring the course meets your needs before making a purchase. Please note that any applicable payment processing fees (e.g., PayPal or card processing fees) may not be refundable and will be deducted from the refund amount.

Photographs and Testimonials

Online Participation:
During live online sessions, you may participate without video. If photographs or screen recordings are to be taken, you will be notified beforehand and can opt out of participating in those recordings.

Testimonials:
We may request feedback or testimonials from you to use in our marketing materials. You have the right to decline.

Amendments and Termination

Amendments:
Medwise reserves the right to amend this Product Agreement at any time. The most recent version will always be available on our website.

Termination of Access:
We reserve the right to terminate your access to any course or service if you breach any part of this Agreement or our other terms and policies.

Applicable Law

Jurisdiction:
This Product Agreement is governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising under this Agreement.
